These Terms of Use govern your use of JetCapture Pilot Logbook and related support pages operated by JetCapture Ltd ("JetCapture", "we", "us", or "our"). By downloading, accessing, or using the app, you agree to these terms.

1. Acknowledgement

These terms are between you and JetCapture Ltd, not Apple. JetCapture, not Apple, is responsible for JetCapture Pilot Logbook, its content, support, and any claims relating to it, except as otherwise required by applicable law.

2. Eligibility and Scope

You may use JetCapture Pilot Logbook only in compliance with applicable law and these terms. If you download the app through the Apple App Store, your use is also subject to Apple's applicable media services terms, usage rules, and store policies.

If JetCapture Pilot Logbook is downloaded from the Apple App Store, your use of the app is also subject to the Apple Standard End User License Agreement, unless a separate custom end user licence agreement is provided.

3. Licence

Subject to these terms, JetCapture grants you a limited, non-exclusive, non-transferable, revocable licence to use JetCapture Pilot Logbook on Apple-branded devices that you own or control, as permitted by the App Store terms and any Family Sharing or similar rights Apple makes available.

You may not copy, resell, modify, reverse engineer, decompile, or create derivative works from the app except where applicable law expressly permits it.

4. App Functionality

JetCapture Pilot Logbook is a local-first pilot logbook for recording and reviewing flight information. Features may change over time, and availability may vary by device, operating system version, or region.

Certain features may rely on Apple services, including optional iCloud sync. Those services are provided by Apple, not JetCapture, and may be unavailable from time to time.

5. Purchases and Billing

If the app offers paid downloads, subscriptions, or in-app purchases, billing, refunds, and payment processing are handled by Apple under the terms that apply to your App Store transaction. JetCapture does not store your payment card details.

6. Your Data and Backups

You are responsible for the accuracy, completeness, and retention of the information you enter into the app and for maintaining any backups you consider necessary. Flight time, duty, licensing, and currency records remain your responsibility, including checking that exported or reported totals match your official records and any regulatory, employer, or insurance requirements that apply to you.

The app is designed so your data stays on your device unless you choose to use iCloud sync. Please review our Privacy Policy for details.

JetCapture does not guarantee that any data will be preserved without interruption, loss, corruption, or deletion. You are responsible for maintaining independent backups and confirming that any imported, exported, synced, or restored data is complete and correct.

JetCapture is solely responsible for any maintenance and support services we choose to provide for the app. Apple has no obligation whatsoever to furnish any maintenance or support services for JetCapture Pilot Logbook.

9. Intellectual Property

The app, website content, branding, and related materials are owned by JetCapture Ltd or its licensors and are protected by applicable intellectual property laws. These terms do not transfer any ownership rights to you.

10. Disclaimers

JetCapture Pilot Logbook is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the app will be uninterrupted, error-free, or suitable for every workflow, operator policy, or regulatory requirement.

The app is intended as a recordkeeping tool and is not legal, accounting, tax, regulatory, employment, medical, or safety advice. You remain responsible for all operational, licensing, compliance, and recordkeeping decisions.

We do not warrant that imports, exports, backups, restores, sync operations, or subscription services will be available at all times or free from delay, corruption, incompatibility, or error.

11. Limitation of Liability

To the fullest extent permitted by law, JetCapture Ltd will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, business opportunity, goodwill, or data, arising out of or related to your use of or inability to use the app.

This limitation includes, without limitation, loss or corruption of logbook records, loss of backups, failed imports or exports, failed restores, sync interruptions, device failure, subscription or entitlement interruptions caused by third-party services, and the cost of reconstructing records or procuring substitute software or services.

Where liability cannot be excluded, JetCapture's total liability will be limited to the amount you paid for the app in the 12 months before the event giving rise to the claim, or GBP 100 if you paid nothing. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law.

12. Product Claims and Third Parties

JetCapture, not Apple, is responsible for addressing claims relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws, subject always to the limits permitted by applicable law.

The app may rely on third-party services, including Apple. We are not responsible for third-party services, third-party terms, or third-party outages, except to the extent required by law.

13. Third-Party Terms and Export Compliance

You must comply with applicable third-party terms when using the app, including Apple terms relevant to App Store use, iCloud, and in-app purchases.

You represent that you are not located in a country subject to applicable trade embargoes and are not on any government list of prohibited or restricted parties where such restrictions would make use of the app unlawful.

14. Termination

These terms remain in effect until terminated. You may stop using the app at any time by uninstalling it. We may suspend or terminate your right to use the app if you materially breach these terms.

15. Changes to These Terms

We may update these terms from time to time. If we make a material change, we will post the updated version on this page with a revised effective date. Continued use of the app after the update takes effect means you accept the revised terms.

16. Governing Law

These terms are governed by the laws of England and Wales, excluding conflict of law rules. Courts located in England and Wales will have exclusive jurisdiction over disputes arising from these terms, except where consumer law in your country of residence provides otherwise.

17. Apple Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, upon your acceptance of them, may enforce these terms against you as a third-party beneficiary.
